MGL 266 Section 30, Embezzling is misappropriating or taking funds which aren’t yours, for your own use. This usually occurs in a business situation where the offender has access to funds to pay employees or vendors.
Embezzlement, is a form of larceny and a crime of moral turpitude. Crimes of moral turpitude or crimes of dishonesty have significant consequences and often times cannot be explained away like other crimes. Most large retail stores will not even consider a job candidate who has been convicted of a crime of dishonesty.
Immigration consequences: ICE takes particular offense to this type of crime. If you are a resident alien, or have status other than that of a US Citizen, one conviction of this type of crime, or numerous convictions stemming from the same scheme, renders you inadmissible. This means if you return to your home country, you may not be readmitted into the U.S. After just two convictions from separate incidents, you are considered deportable. At this point ICE can detain you and commence deportation proceedings.
